Terms of Use
These Terms of Use (“Terms”) govern your access to and use of TheTopConcerts websites and related services (the “Service”). The Service is operated by Fever Up Entertainment (the same legal entity as Fever, “Fever”, “we”, “us”). By using the Service you agree to these Terms.
What the Service provides
TheTopConcerts helps you discover concerts and live events and find links to purchase tickets or plans from Fever and other partners. Event information (dates, venues, descriptions, images) may come from data feeds and third parties and is provided for convenience only.
We may update, suspend, or discontinue features of the Service at any time. We do not guarantee that any event will remain available or that listings are complete, accurate, or up to date.
Tickets and third-party services
When you follow a link to buy tickets or register for an event, you leave our site and enter a separate agreement with the ticket seller or platform (for example Fever or another partner). Pricing, fees, refunds, cancellations, and customer support for those purchases are governed solely by that provider’s terms and policies.
We are not responsible for the availability, quality, safety, or performance of events run by venues, promoters, or artists.
Accounts and eligibility
Where the Service allows account creation or sign-in, you must provide accurate information and keep your credentials secure. You are responsible for activity under your account unless you notify us of unauthorized use in line with any process we publish.
You must be old enough under applicable law to enter binding contracts for the actions you take through the Service.
Acceptable use
You agree not to misuse the Service. For example, you must not: scrape or overload our systems without permission; attempt to bypass security; use the Service to distribute malware or spam; misrepresent your identity; or use automated means in a way that degrades the Service for others.
We may investigate and take technical or legal action—including suspending access—if we believe you have violated these Terms or applicable law.
Intellectual property
The Service, including branding, layout, text, graphics, and software, is owned by Fever or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except where allowed by law or with our prior written consent.
Disclaimers and limitation of liability
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, neither Fever nor its affiliates will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims arising out of the Service is limited to the greater of (a) the amounts you paid us directly for the Service in the twelve months before the claim or (b) one hundred euros (€100), except where liability cannot be limited under mandatory law.
Indemnity
You will defend, indemnify, and hold harmless Fever and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms or applicable law.
Changes and governing law
We may modify these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. Material changes may be communicated through the Service or by other reasonable means where required by law.
Unless a different mandatory law applies where you live, these Terms are governed by the laws of Spain, and the courts of Madrid shall have exclusive jurisdiction, subject to any non-waivable rights you may have as a consumer.
